In mediation, we often focus on techniques, strategies, and outcomes. Yet beneath the surface of every successful negotiation lies something far more fundamental: trust. Warren Buffett wisely observed, “Trust is like the air we breathe. When it’s present, nobody really notices. But when it’s absent, everybody notices.”
This insight resonates deeply in my mediation practice, where I’ve witnessed the profound impact trust has on negotiation dynamics.
We all know practitioners whose name causes you to choke a little.
A fundamental truth about negotiation I’ve observed repeatedly: it’s rarely a one-time event. Instead, it’s part of an ongoing relationship where trust serves as currency more valuable than any immediate advantage.
When trust is present in a negotiation:
- Information flows more freely
- Parties feel safe exploring creative solutions
- Compromises become opportunities rather than concessions
- Implementation of agreements happens with less friction
When trust is absent, everything becomes harder. Positions become entrenched, information is withheld, and simple agreements require extensive verification mechanisms.
As mediators, our role isn’t just to facilitate agreement, but to help create an environment where trust can flourish. This means encouraging transparency, acknowledging vulnerabilities, and recognising that negotiation isn’t about maximising gain in a single interaction but building foundations for sustainable relationships.
When parties prioritise short-term gains over relationship-building, they may win the battle but ultimately lose the war. Engaging in behaviour which may cause an opposing party to distrust you will mean that over time you will have fewer chances to negotiate. The value of maintaining trust isn’t just moral—it’s practical. It keeps doors open for future opportunities that might hold far greater value than whatever can be extracted from a single negotiation.
In my practice, I’ve found that parties who approach negotiation with a trust-building mindset consistently achieve more sustainable, mutually beneficial outcomes. They understand that, like the air we breathe, trust may be invisible—but it’s absolutely essential.
